1. Scope
These Terms of Service (“Terms”) govern your use of the Tonsify website, services, APIs, documentation, and related materials (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.
1. Nature of Tonsify’s Services
Tonsify provides technical infrastructure and orchestration software for payment routing, on-chain execution, and third-party service integration.
Tonsify is NOT:
∙ a bank
∙ a payment institution
∙ a custodian
∙ a wallet provider
∙ a money transmitter
Tonsify does not hold, custody, or control user funds at any time.
2. Third-Party Services
The Services integrate or interact with third-party providers, including but not limited to:
∙ payment service providers (PSPs)
∙ on-ramp and off-ramp providers
∙ blockchain networks and smart contracts
∙ wallet providers
These third parties operate independently and under their own terms, fees, compliance requirements, and legal obligations. Tonsify is not responsible for the performance, availability, or compliance of third-party services.
3. User Responsibilities
You are solely responsible for:
∙ ensuring that your use of the Services is lawful in your country of residence
∙ complying with applicable laws, including financial, tax, sanctions, and AML/KYC regulations
∙ verifying that the Services and any integrated third-party services are permitted in your jurisdiction
Tonsify does not provide legal, tax, or regulatory advice.
4. No Custody / No Fiduciary Relationship
Tonsify does not:
∙ receive or store fiat or crypto assets
∙ act as an intermediary holding funds
∙ assume fiduciary duties toward users
All transactions occur directly between users and third-party providers or on-chain protocols.
5. Risks and On-Chain Activity
You acknowledge and accept the inherent risks of:
∙ blockchain technology
∙ smart contracts
∙ network congestion or failure
∙ protocol upgrades or forks
∙ irreversible transactions
Tonsify provides the Services “as is” and makes no guarantees regarding outcomes or execution.
6. Limitation of Liability
To the maximum extent permitted by law, Tonsify shall not be liable for:
∙ indirect, incidental, or consequential damages
∙ loss of funds caused by third-party providers or protocols
∙ regulatory actions affecting third-party services
∙ user errors or misconfigurations
∙ downtime or service interruptions
Total liability, if any, shall be limited to the amount paid to Tonsify for the relevant service, if applicable.
7. Intellectual Property
All intellectual property rights in the Services, including software, documentation, algorithms, and designs, remain the exclusive property of Tonsify. No license is granted except as explicitly stated.
8. Termination
Tonsify may restrict or terminate access to the Services at any time to ensure compliance, security, or legal obligations.
9. Governing Law
These Terms shall be governed by the laws of Switzerland, excluding conflict of law principles.
10. Changes
Tonsify may update these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.
